TERMS OF SALES
Preamble
The website
is a PHA fully proprietary website along with all the relative rights. Any
reproduction, whether in full or partial, is systematically subjected to the
authorisation of the owners. However, hypertext links to the website are
authorised without the need for any specific request.
1.
Acceptance of conditions Customers
acknowledges having knowledge, at the time of placing the order, of the
specific conditions of sale stated on this screen and expressly declare
accepting them unconditionally.
These
general conditions of sale govern the contractual relations between PHA
(Philibert & Associés) and its customers and both parties accept them
unconditionally. These general conditions of sale prevail over any other
conditions featured in any other document, unless subject to prior express
dispensation in writing.
2. Order
The
automatic recording systems are deemed as vouching for the nature, contents and
date of the order. PHA confirms the acceptance of its order to the customer to
the email address the latter forwarded. The sale shall be concluded from the validation
of order.
PHA
reserves the right to cancel any order from a customer with whom it has a
dispute relating to a previous order.
The
information stated by the buyer at the time of placing the order commits the
latter: in the event of errors in the details of the recipient, the vendor may
not be held responsible for its inability to deliver the product.
3. Delivery
With regard
to the "Grand Prix de France moto 2012", it is expressly stipulated
that no tickets will be sent before April 2012.
The
delivery will be made through :
- by
French post via "courrier suivi" (tracking system) in mainland France.
- by
international post mail “DHL” for countries excluding France. See the list of
available countries during the ordering process
For other
countries in the world, tickets will be withdrawn on the circuit, at the
Welcome Centre "ACCUEIL" (Centre des Expositions, near North
entrance) from Thursday 17 May
The
commitment of the vendor is to ensure all deliveries to D-8 of the event.
Any delays
shall not entitle the purchaser to claim for damages.
The
following cases are considered as force majeure discharging the vendor of its
obligation to deliver: war, riots, fire, strikes, accidents.
For
availability reasons, an order may be delivered in several lots to customer. If
the customer wants different places of delivery, he must place as many orders
as shipping addresses, with each order the payment of postage. If customers
place several orders on different days, it is possible that all orders are
grouped into a single delivery, in which case no refund of shipping charges
will be taken into account.
If the time
between the date of the order and the date of the event is less than 15 days,
dispatches may no longer be made by post. Only the option to collect tickets at
the track remains available.
4.
Retraction
A ticket is
not refundable even if lost or stolen, returned or exchanged unless the event
of cancellation or acceptance of PHA prior to refund the order.
No request
will be considered after the deadline of two weeks after the date of the event.
From the
date of dispatch of the items, no request for cancellation may be taken into
considered before receipt of the items returned to PHA - 15 bis place Renoux –
63000 Clermont-Ferrand (France). PHA will be
able to refund items, except for shipping, within a period not exceeding 2
weeks following the date of the event.
In the
event of the retraction right being availed of before dispatch of the items,
PHA may reimburse amounts paid by the customer at no charge.
A ticket
may not be resold at a price greater than its face value.
5. Price
The price
is expressed in euros.
The price
quoted on the product sheets does not include transport.
The price
listed in the order confirmation is the final price. This price includes the
price of products, management fees and postage
6. Payment
The price
invoiced to customer is the price shown on the order confirmation sent by PHA.
The price
of the products is payable in cash on the day of the actual order.
The payment
is made by credit card bearing the sign CB (Carte bleue, Visa, Eurocard,
Mastercard)
The order
is deemed effective and approved by PHA when the transaction has been accepted
by the banking platform. In case of refusal, the order will be canceled and the
customer notified by email.
Furthermore,
PHA reserves the right to refuse any order from a customer with whom it has a
dispute.
Payments by
cheque(only on french bank) or bank
transfer equivalent to a power option. After a period of 5 days, all online
order not regularized is considered void.
7. Secured
payment
For the
security of payments, we use Paybox, the solution of payment by credit card
developed by Paybox.
With this
system, your payment is made directly on the secure server PAYBOX on our
behalf. At no time your card number will be communicated to us. The exchanges
are encrypted and secured using SSL 3 (Secure Socket Layer) on the Internet
protocol has become a global standard supported by major browsers.
8. Disputes
This
agreement is subjected to French law. PHA's responsibility, shall, in all
cases, be limited to the amount of the order and shall not be challenged for
any simple errors or omissions that may exist despite all the precautions taken
in the presentation of the products. Claims or contestations shall always be
received in all kindness, with good faith always being presumed of the party
going to the trouble of expressing its position. In the event of a dispute, the
customer shall contact the company in priority in order to arrive at an
amicable solution.
Failure to
achieve this, the Tribunal de Commerce (commercial court) of Clermont-Fd is
solely competent, regardless of the place of delivery and the mode of payment
accepted.
9. Legal statements
The personal data collected for the purpose of
remote sales is compulsory as this data is indispensable in order to process
and route orders, draw up invoices and warranty contracts. Failure to provide
data gives rise to the order not being confirmed. In compliance with the "
Informatique et Libertés " (data protection) act, the processing of
personal data relating to customers has been covered by a declaration to the
Commission Nationale de l'Informatique et des Libertés (CNIL) (French data
protection authority). Customers have (article 34 of the law of 6th January
1978) a right of access, modification, rectification and suppression of the
data relating to them which they may avail of from PHA. In addition, PHA
undertakes to refrain from passing on the details of its customers to a third
party, whether free of charge or for a counterpart.
